Terms and Conditions for PS.Babystuff Personal Shopping Services


  1. Introduction

These terms and conditions (hereinafter referred to as the “Agreement”) govern the use of personal shopping services provided by PS.Babystuff (hereinafter referred to as “PS.Babystuff”, “we,” “us,” or “our”) to our customers (hereinafter referred to as “the customers,” “you” or “your”). By accessing and using our services, you acknowledge and agree to be bound by the terms and conditions set forth in this Agreement.

  1. Scope of Services

PS.Babystuff offers personal shopping services that involve the procurement of baby products and related items as requested by customers. We shall exercise reasonable care and diligence in fulfilling your shopping requirements. However, please note that we do not manufacture or produce these products and rely on the information provided by third-party vendors and manufacturers.

  1. Pre-order Reservation & Process

3.1      The concept of pre-ordering items from PS.Babystuff is a self-service process. Customers are required to do their own shopping at designated website brands and should send a screenshot of their cart to PS.Babystuff’s WhatsApp for a price quotation inquiry.

3.2      PS.Babystuff provides shopping tutorials, size measurement guidelines, and product knowledge on its Instagram Story pinned highlights. New customers and followers are encouraged to conduct their research before placing an order. If you have any doubts, you are advised to seek assistance from PS.Babystuff via WhatsApp.

3.3      To avail our personal shopping services, you must submit a shopping request through our designated communication channels; Instagram, Telegram, or WhatsApp.

3.4      Each price quotation inquiry shall be limited to a maximum of 5 items per cart. PS.Babystuff reserves the right to ignore and reject inquiries containing excessive items without any intention to secure the order from the customers. Customers who have previously engaged in order cancellations or acted as backout or joy buyers will be blacklisted, and their orders will not be entertained.

3.5      Customers bear sole responsibility for providing precise and comprehensive information pertaining to the requested products, encompassing specifications, quantity, size, color, and any other pertinent details. In order to obtain a price quotation, kindly submit a complete screenshot cart. PS.Babystuff shall not assume liability or responsibility for any miscommunication arising from inaccurate information due to incomplete screenshot carts provided by the customers, involving any parties.

3.6      We will provide you with a quotation based on the information you provided. By confirming the quotation and making payment, you agree to proceed with the order.

3.7      All prices quoted are in Malaysian Ringgit (MYR). The purchase price (the “Price”) includes service charge, international shipping fee, and handling fee by our logistic partner. If the Price of an item drops after you have pre-ordered, we will adjust the price difference or refund accordingly. However, if the Price increases, your order will be secured at the originally agreed low Price.

3.8      When placing a pre-order with PS.Babystuff, you must provide accurate personal information, including name, contact number, and address. You are responsible for keeping this information up-to-date. We will not be held liable for any inaccuracies or outdated information. You can update your information before the item is shipped by notifying us via WhatsApp.

3.9      Once the payment is made to PS.Babystuff, you cannot cancel your order. In the event that you insist on canceling the order, the early deposit made to us will not be refunded. However, if we are unable to secure your order due to a sold-out item and you subsequently cancel the order, a full refund will be provided.

  1. Product Availability and Substitution

4.1      PS.Babystuff will make efforts to secure your orders, subject to stock availability on the website. It is highly recommended for you to avoid selecting low-stock items. In the event that a product you requested is unavailable or sold out, we will notify you and offer suitable alternatives for your approval.

4.2      You may choose to accept the proposed substitute or cancel the item from your order. PS.Babystuff will process payment refunds for any order cancellations.

  1. Payment

5.1      PS.Babystuff offers three types of payment methods: full payment, 2-time installment, and a 3-time installment plan. You can choose the payment method that best suits your needs.

5.2      Currently, the 3-time installment plan is only available for Ralph Lauren brand items. PS.Babystuff plans to expand the 3-time installment plan to include all brands in the future.

5.3      Payments must be made via instant online banking transfer and QR transfer. You can choose to pay either the full amount, 50% deposit, or 30% deposit, as stated in the WhatsApp bill. Payment should be made immediately upon submitting the pre-order. Interbank GIRO (IBG) transfers are not allowed.

5.4      Pre-orders from customers in other countries (e.g.: Singapore, Brunei) will only be confirmed once the payment is cleared and received in PS.Babystuff’s bank statement. We will not proceed with the order while the payment is still floating in the bank.

5.5      PS.Babystuff will not be responsible for any sold-out items due to late payment confirmation. Customers are encouraged to make payments as soon as possible to secure their items.

5.6      In the event of payment failure or refusal, we reserve the right to cancel your order without any liability.

5.7      Once the item has arrived safely in Malaysia, you will be given fourteen (14) days to complete the deposit balance. If you fail to remit the payment after the specified period, an additional surcharge of RM 5 per day will be imposed. Subsequently, failure to make payment within 30 days will result in the forfeiture of the deposit, and the item will be auctioned.

5.8      Should you encounter any limitations that prevent you from fulfilling the deposit balance within the stipulated fourteen (14) days, such as insufficient funds or awaiting salary, we kindly request that you inform us in advance. We would appreciate it if you could reschedule your available date to complete the balance payment. Failure to remit the payment within the agreed reschedule date will result in an additional surcharge of RM 5 per day.

  1. Delivery Schedule

6.1      Estimated Time of Arrival (ETA) for shipments are based on the shipping schedule of our logistic company. While we can track and trace the package, the exact date and time of its arrival in Malaysia cannot be guaranteed due to factors beyond our control (e.g., technical problems of the shipping company, natural disasters, public holidays, customs clearing). Shipments from the United States of America, United Kingdom, and Australia usually take 4-6 weeks from the date of pre-order. Some shipments (especially Ralph Lauren brand) will take a longer ETA than usual (8-10 weeks). You are advised to manage your expectations and should not proceed with the order if you cannot wait.

6.2      Upon the arrival and receipt of shipments by our team, we will promptly notify you via WhatsApp, using your designated order number as reference. We kindly request that you refrain from spamming or urging immediate shipping, as we adhere to a systematic order processing. Your patience is appreciated, and we assure you that you will be notified with a picture of your item once it is your turn. In the event of persistent attempts to expedite the process, which may interfere with other customers’ queue, we reserve the right to prioritize your notification as the last in line.

6.3      Following the arrival of the shipment, PS.Babystuff will diligently pack all orders within 7 days and arrange for local postage. In the unfortunate event of lost items during international shipments or upon receiving insufficient and defective items from the brand’s manufacturer, PS.Babystuff shall initiate a refund for the affected item. We kindly request that the customer returns the defective item, and PS.Babystuff will cover the postage fee for the return. As a gesture of appreciation, we will also offer a discount voucher for the customer’s next purchase, with the value of the voucher at PS.Babystuff’s discretion.

        7.   Returns and Refunds

7.1      We solely accept returns for products that are damaged or defective directly from the brand’s manufacturer. It is essential to note that this inconvenience is beyond our control. We understand that, in some cases, despite our best efforts to secure the order, unforeseen technical problems may arise, and we appreciate your understanding in such situations.

7.2      To initiate a return, you must notify us within 7 days from the date of delivery and follow our return instructions.

7.3      Refunds will be issued using the original payment method, and the amount refunded will be limited to the purchase price of the returned product.

  1. Limitation of Liability

8.1      PS.Babystuff shall not be liable for any indirect, consequential, incidental, or punitive damages arising out of or in connection with our services, including but not limited to lost profits or business interruption.

8.2      Our liability for any claim related to our services shall not exceed the total amount paid by you for the specific order giving rise to the claim.

  1. Indemnification

You agree to indemnify, defend, and hold PS.Babystuff and its affiliates and employees harmless from and against any claims, losses, liabilities, expenses, and damages, including reasonable attorney’s fees, arising from your use of our services, violation of this Agreement, or infringement of any rights of third parties.

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Malaysia.

  1. Amendment and Termination

11.1    We reserve the right to amend or modify these terms and conditions at any time, and such changes shall be effective upon posting on our platforms or providing notice to you.

11.2    We may terminate this Agreement and our services to you at any time for any reason.

  1. Entire Agreement

This Agreement constitutes the entire understanding between PS.Babystuff and you with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.

By using our personal shopping services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this Agreement.
